Loanworks – Lending Privacy Policy

Sintex Consolidated Pty Ltd (ABN 75 065 917 535), Australian Credit Licence 385129, Australian Financial Services License 385129, trading as Loanworks (Loanworks) is committed to complying with its obligations under the Privacy Act 1988 (Cth) (the Act) and the Australian Privacy Principles (APPs) set out in Schedule 1 to the Act.

Purpose

The purpose of this Privacy Policy is to set out how Loanworks collects, uses, discloses and protects personal information in accordance with the Act and applicable guidance published by the Office of the Australian Information Commissioner (OAIC). This Privacy Policy is designed to inform you of:

  • The kinds of personal information that Loanworks collects and holds
  • How Loanworks collects and holds personal information
  • The purposes for which Loanworks collects, holds, uses and discloses personal information
  • Your rights as to how Loanworks uses information about you, including how you can access and update certain information about you
  • Loanworks’ processes for storing and securing your personal information; and
  • How you may contact or make a complaint about Loanworks (if you believe or are concerned that Loanworks has breached an APP) and how Loanworks will deal with such a complaint

This Privacy Policy applies only to the extent Loanworks collects, uses and discloses personal information in connection with the Loanworks website (www.loanworks.com.au) (Website). Loanworks also has a privacy notice which details its privacy policy in connection with its credit related activities (Privacy Notice). Borrower and guarantors, including prospective borrowers and guarantors (you or your), can request a copy of the Privacy Notice by contacting the Loanworks Privacy Officer (details below).

This Privacy Policy may be revised and/ or updated from time to time. Loanworks will notify you of any changes to this Privacy Policy by posting the revised/ updated Privacy Policy on the Website. You should review this Privacy Policy periodically for any changes which will be effective from the date they are posted on the Website.

What is personal information

The Act allows personal information to be collected, used and disclosed for the purposes specified in this Privacy Policy. Personal information is any information or opinion which is reasonably identifiable as being about you, including (without limitation) your name, email address, telephone number, bank account details, payment information and other information relating to the collection and verification of identification documents. If the information about you cannot be reasonably connected to you, this Privacy Policy does not apply as your de-identified information is not personal information (for example, where Loanworks has aggregated and anonymised your personal information).

Information collected

Loanworks will only collect personal information by lawful and fair means, which is reasonably necessary for the provision of its products and services. This information can be categorised as:

  • Information you provide to Loanworks directly (whether electronically or in person) – You may provide basic information such as your name, phone number, address or email address to enable Loanworks to send information, provide updates and process your application for a product or service. Loanworks may collect additional information at other times, including (without limitation) when you provide feedback, change your content or email preference, respond to surveys and/ or promotions, provide financial or credit card information or communicate with customer service/ sales staff.
  • Information which Loanworks collects automatically – When you access the Website, Loanworks may collect certain information about you such as your IP address, the pages of the Website you visit, the time and date of your visit, the overall time you spent on the Website and other statistics. This information is used in an aggregated manner to analyse how people use the Website, such that Loanworks can improve its service.
  • Information which Loanworks receives from third parties – The Website may feature links to other websites not owned or controlled by Loanworks from time to time. These links are meant for your convenience or information only. Loanworks has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party sites or services.

Information used or disclosed

Loanworks will use and disclose personal information covered by this Privacy Policy only for the primary purpose of either:

  • Providing registered Mortgage Managers and/ or Brokers with information and documentation concerning their function as Mortgage Manager and/ or Broker to Loanworks in respect of its lending programs (Mortgage Managers and/ or Brokers who access the “Originator” section of the Website have already been registered with Loanworks as the Website does not facilitate new originator registrations)
  • Maintaining and updating your records and customer files with Loanworks
  • Allowing personal information to be used and distributed by related entities in a controlled manner to registered Mortgage Managers and/ or Brokers and any other users of the Website (if any)
  • Providing services and customer support, including service updates and comparing your identification information for accuracy and verifying it with third parties (to the extent we have obtained your consent for such disclosure, where appropriate).

Notwithstanding the above, in certain circumstances, Loanworks may also use or disclose personal information for a secondary purpose (in addition to the primary purpose). Personal information may be applied towards a secondary purpose if the secondary purpose is related to a primary purpose of collection and the use or disclosure would be within your reasonable expectations. Relevant secondary purposes arising in connection with this Privacy Policy may include (without limitation):

  • Improving Loanworks’ provision of products and services and better understanding your needs
  • Providing you with information, updates and services and making you aware of new and additional products, services and opportunities available to you
  • Providing personal information as authorised or required by law or a relevant government body or authority
  • Other secondary purposes set out or referred to in this Privacy Policy

Data transfers

Information that Loanworks collects may be stored or processed by, or transferred between, parties located in countries outside Australia from time to time.

Loanworks will ensure that appropriate safeguards are in place to protect your personal data to the extent it is transmitted outside Australia, either through adequate protection mechanisms or compliance with the European Commission’s Standard Contractual Clauses (for data transfers between EU and non-EU countries) (which is considered to be industry best practice).

If there is a change in control of Loanworks or a sale or transfer of business assets, Loanworks reserves the right to transfer, to the extent permissible by law, its user databases, together with any personal information and non-personal information contained in such databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality.

Cookies

Cookies are files with small amounts of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your computer’s hard drive. Loanworks may use cookies to collect information. You can always instruct your browser to disable some or all cookies or indicate when a cookie is being sent. However, if you reject a cookie, the Website may not function as effectively, and you may not be able to use certain portions of the Website. For Mortgage Managers and Brokers, Loanworks may send a session cookie to your computer when you login and access the Originator services housed on the Website. This type of cookie enhances your user experience. For example, if you visit multiple pages on the Website during the same session, a session cookie enables you to not have to enter your password on each page. Once you log out or close your browser, the cookie expires. Loanworks may also use longer-lasting cookies for other purposes such as to display your content and account information. Loanworks encodes its cookies so that only it can interpret the information stored in them.

Marketing and opt-out

Loanworks may use the information received from Mortgage Managers and Brokers, including your personal information, for marketing and research purposes, to analyse and improve products, benefits, and services and to inform an Originator of products and services provided by Loanworks, its related entities or preferred suppliers which Loanworks considers may be of value or interest to the Originator unless the Originator opts out. If an Originator does not wish to receive any information about such products and services, they can contact the Loanworks Privacy Officer.

Security of your personal information

Loanworks is committed to ensuring the personal information you provide is stored securely. To prevent unauthorised access or disclosure, Loanworks has put in place appropriate physical, electronic, and operational procedures to safeguard and secure information and protect it from misuse, interference, loss, and unauthorised access, modification and disclosure. Where personal information is no longer required to be held or retained by Loanworks for any purpose or legal obligation, it will take all reasonable steps to destroy or de-identify the information accordingly.

If Loanworks receives any personal information about an individual which is unsolicited by it and not required for the provision of its products or services, it will destroy the information (to the extent it is lawful and reasonable for Loanworks to do so).

Anonymity

General users of the Website do not need to disclose their identity to Loanworks to use the Website. This Website does not collect personal information about general users except in the circumstances described above. However, Mortgage Managers and Brokers wishing to login and access the Originator services via the Website will not be able to maintain anonymity for the purposes of accessing these parts of the Website.

Accessing your personal information

You may request Loanworks to give you access to personal information it holds about you, or update such information, by emailing compliance@loanworks.com.au or calling (02) 9278 9700. Loanworks will take reasonable steps to respond to your request within 30 days. At your request to update personal information held about you (or where it is otherwise appropriate to do so) Loanworks will provide any updated information to the provider of that information (for example, Loanworks’ client). You will always have the right to request the correction of your personal information, at no cost to you. Loanworks may also correct your personal information where it is satisfied the information is inaccurate, out-of-date, incomplete, irrelevant or misleading, having regard to a purpose for which it is held.

Complaints about privacy

If you have any questions, concerns, requests or complaints in connection with this Privacy Policy or Loanworks’ privacy practices, please contact the Loanworks Privacy Officer.

Loanworks takes complaints very seriously and will reach out to you as soon as practicable after receiving written notice of your complaint.

Acceptance of this Privacy Policy

By using the Website, or accessing any of Loanworks’ services or features, you acknowledge having read and understood this Privacy Policy and the permissions to collect, use and disclose personal information. You authorise Loanworks to collect, use and disclose, in accordance with the Act, your personal information for the purposes specified in this Privacy Policy.
